1. Eligibility and agreement

By accessing or using CheckMyPlate.ai, you confirm that:

• You are at least 16 years old (or the minimum age in your jurisdiction).
• You have the legal capacity to enter into a binding agreement.
• You will use the service only in accordance with these Terms and applicable laws.

If you do not agree to these Terms, please do not use the service.

2. Service description

CheckMyPlate.ai is a chat-based nutrition assistant. You can send meal photos and short messages via WhatsApp or Telegram, and we use AI models (such as OpenAI or Google Gemini) to estimate nutritional values, help track your intake, and provide simple guidance based on your goals. We may update, improve, or modify features over time.

3. No medical or professional advice

The service provides general information and approximate nutrition estimates for educational and self-tracking purposes only. It is not a substitute for professional medical, dietary, or health advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making major changes to your diet, exercise, or medication. Never ignore or delay seeking professional advice because of information obtained through CheckMyPlate.ai.

4. Accounts and messaging platforms

You access the service by messaging our account or bot on supported platforms (such as WhatsApp or Telegram).

• You are responsible for keeping control of your phone number and messaging accounts.
• Messages sent via WhatsApp or Telegram are processed by those platforms under their own terms and privacy policies.
• You are responsible for all activity that occurs via your messaging account with CheckMyPlate.ai.

5. Subscriptions, billing, and refunds

CheckMyPlate.ai is offered as a paid subscription service (for example, weekly or monthly plans). The current prices and currency options are shown on our website or in the signup flow.

• Billing: Payments are processed by third-party providers such as Stripe. By subscribing, you authorize recurring charges until you cancel.
• Renewals: Subscriptions renew automatically at the end of each billing period unless cancelled in advance.
• Cancellation: You can cancel via the methods described in the service (for example, link or command in chat) or via the billing portal if available.
• Refunds: Unless required by law, fees are non-refundable once a billing period has started, but you will retain access until the end of that period.

Local consumer protection laws may grant you additional rights (such as a withdrawal period). Where applicable, those rights still apply.

6. Acceptable use

You agree not to use the service to:

• Break any laws or infringe the rights of others.
• Upload or transmit content that is illegal, harmful, abusive, or hateful.
• Send spam, automated messages, or attempt to overload or disrupt the service.
• Reverse engineer, modify, or interfere with the service except where permitted by law.

We may suspend or terminate your access if we reasonably believe you have violated these Terms.

7. Your content and license to us

You retain all rights to the content you send (photos, messages, notes), subject to the rights you grant us below.

You grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content solely as needed to operate, improve, and provide the service (including through third-party providers such as AI and hosting services).

8. Privacy and data protection

Our use of your personal data is described in our Privacy Policy. By using the service, you acknowledge that your data will be processed as described there, including transfer to third-party providers and, where relevant, to other countries.

9. Intellectual property

All rights in and to the service, including the website, brand, software, and AI-generated messages (excluding your original content), belong to us or our licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the service for personal, non-commercial purposes in accordance with these Terms.

10. Disclaimers

The service is provided on an “as is” and “as available” basis.

• We do not guarantee that nutrition estimates or suggestions will be complete, accurate, or suitable for every person or situation.
• We do not guarantee that the service will be uninterrupted, secure, or error-free at all times.
• To the fullest extent permitted by law, we exclude all warranties (express or implied) about the service, except where such warranties cannot be excluded under applicable law.

11. Limitation of liability

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits, revenue, or data arising from your use of the service.
• Our total aggregate liability for any claims relating to the service will be limited to the amount you paid us for the service in the 3 months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so the above may not apply to you in full.

12. Suspension and termination

You may stop using the service at any time and cancel your subscription as described above. We may suspend or terminate your access if you materially breach these Terms, misuse the service, or if we discontinue the service. Where reasonable, we will try to give you notice in advance.

13. Changes to the service or these Terms

We may update the service and these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, inform you via our website or in chat. Your continued use of the service after the changes take effect means you accept the updated Terms.

14. Governing law and disputes

These Terms will be governed by and construed in accordance with the laws of the Republic of Latvia, excluding its conflict of law rules. Any disputes arising out of or in connection with these Terms or the service will be subject to the non-exclusive jurisdiction of the courts of the Republic of Latvia, unless mandatory local law gives you the right to bring claims elsewhere.
